Gymini Pty Ltd ("Gymini", "we", "us", or "our") operates the Gymini platform (getgymini.com and associated services). This Privacy Policy explains how we collect, use, share, and protect your personal information when you use our services.


1. Information We Collect

1.1 Account Information

When you create a Gymini account, we collect:

Full name and email address

Business name and contact details

Login credentials (passwords are stored using one-way hashing and are never accessible in plain text)

1.2 Client and Contact Data (CRM)

Gymini is a client relationship management platform. Businesses using Gymini may store information about their clients, patients, members, and leads ("Contacts"), including:

Names, email addresses, phone numbers, and physical addresses

Date of birth and emergency contact details

Health screening information and clinical notes

Membership details, attendance records, and appointment history

Communication preferences and consent status

This data is entered and controlled by the business operating the Gymini account (the "Tenant"). Gymini acts as a data processor on behalf of each Tenant, who is the data controller.

1.3 Connected Email Accounts (Gmail & Outlook)

When a user connects their Gmail or Microsoft Outlook account, Gymini accesses:

Email messages — Only emails where a sender or recipient matches a known Contact in your CRM are synced. Staff-to-staff emails, personal emails, and messages to/from unknown addresses are never accessed or stored.

Email address and profile name — Used to identify the connected account within Gymini.

OAuth tokens — Encrypted access and refresh tokens that allow Gymini to sync emails on your behalf. These can be revoked at any time by disconnecting the account.

What we do NOT access from your email:

Emails between you and people who are not Contacts in your CRM

Emails between staff members within your organisation

Drafts, spam, or deleted messages

Attachments (only email text content is synced)

Contacts, calendar events, or any other Google/Microsoft data beyond the stated scopes

1.4 Connected Calendar Accounts

When a user connects Google Calendar or Outlook Calendar, Gymini accesses:

Calendar event details for scheduling awareness (times, titles, availability)

No calendar data is shared with other users or tenants

1.5 Payment Information

Gymini uses Stripe to process payments. We do not store credit card numbers, CVVs, or full card details on our servers. Stripe handles payment data in accordance with PCI-DSS standards. We store:

Stripe customer IDs and subscription references

Transaction history and invoice records

1.6 Communications Data

Messages sent through Gymini's Communications Hub (SMS, email, WhatsApp, Instagram DMs, internal notes) are stored to maintain conversation history. This includes:

Message content, sender, recipient, timestamps

Channel used (SMS, email, WhatsApp, etc.)

Read/delivery status where available

1.7 Website and Activity Tracking

If a Tenant uses Gymini's website builder or tracking features, we may collect:

Page views, clicks, and form submissions from website visitors

UTM parameters, referrer information, and attribution data

IP addresses (for analytics purposes only, not shared with third parties)

1.8 Usage Data

We automatically collect:

Browser type, device information, and operating system

Pages visited within Gymini and feature usage patterns

Log data including IP addresses, access times, and error reports


2. How We Use Your Information

We use collected information to:

Provide the Service — Operate the CRM, manage appointments, process memberships, facilitate communications, and sync emails

Improve the Platform — Analyse usage patterns to enhance features and user experience

Process Payments — Handle subscription billing, membership payments, and invoice management via Stripe

Send Notifications — Deliver appointment reminders, membership alerts, and system notifications

Provide Support — Respond to support requests and troubleshoot issues

Ensure Security — Detect and prevent fraud, abuse, and unauthorised access

Comply with Legal Obligations — Meet regulatory requirements including HIPAA, GDPR, and Australian Privacy Act obligations where applicable


3. How We Share Your Information

We do not sell your personal information. We share data only in these circumstances:

3.1 Service Providers

We use trusted third-party services to operate Gymini:

Stripe — Payment processing

Resend — Transactional email delivery

Twilio — SMS messaging

Google — Gmail API and Calendar API (when connected by users)

Microsoft — Outlook/Microsoft 365 API (when connected by users)

OpenAI — AI-powered features (no personally identifiable data is sent to AI models unless explicitly triggered by the user)

3.2 At the Tenant's Direction

Tenant administrators control their organisation's data. When a Tenant uses Gymini to send communications to their Contacts, that data flows through the configured channels (email, SMS, etc.).

3.3 Legal Requirements

We may disclose information if required by law, regulation, legal process, or governmental request.

3.4 Business Transfers

In the event of a merger, acquisition, or sale of assets, user data may be transferred as part of the transaction. We will notify affected users before their data is subject to a different privacy policy.


4. Data Security

We implement industry-standard security measures including:

Encrypted data transmission (TLS/HTTPS)

Encrypted storage of OAuth tokens and sensitive credentials

Password hashing using cryptographic algorithms

Role-based access control within the platform

Multi-tenant data isolation — each Tenant's data is logically separated and inaccessible to other Tenants

Regular security reviews and updates


5. Data Retention

Account Data — Retained for the duration of your account plus 30 days after deletion

CRM Data — Retained for the duration of the Tenant's account. Tenants can delete individual records at any time

Synced Emails — Retained while the email connection is active. Disconnecting an email account removes all synced email data from Gymini

Communications — Retained for the duration of the Tenant's account

Payment Records — Retained as required by tax and financial regulations (typically 7 years)

Usage Logs — Retained for up to 12 months for analytics and security purposes


6. Your Rights

Depending on your jurisdiction, you may have the following rights:

Access — Request a copy of the personal data we hold about you

Correction — Request correction of inaccurate data

Deletion — Request deletion of your personal data (subject to legal retention requirements)

Disconnect — Revoke access to connected accounts (Gmail, Outlook, etc.) at any time through Settings

7. Regulatory Compliance

7.1 Multi-Framework Compliance Platform

Gymini includes a built-in compliance module that supports multiple regulatory frameworks. Tenants can configure their compliance obligations based on their jurisdiction and industry. Supported frameworks include:

Access Controls — Role-based access control (RBAC) ensures only authorised staff can access PHI

Minimum Necessary Standard — Gymini's permission system supports limiting access to only the information needed for each user's role

Audit Logging — Comprehensive audit trails track access to, creation of, and modifications to PHI

Encryption — Data is encrypted in transit (TLS/HTTPS) and sensitive credentials are encrypted at rest

Breach Notification — Gymini supports HIPAA breach notification requirements. In the event of a qualifying data breach, we will notify affected Tenants within 72 hours so they can fulfill their notification obligations

7.3 GDPR Compliance

For Tenants processing data of EU/UK residents:

Lawful Basis for Processing — Gymini processes personal data on behalf of Tenants based on the Tenant's lawful basis (typically consent, contractual necessity, or legitimate interest). Gymini as a data processor relies on the Data Processing Agreement with each Tenant

Data Processing Agreements (DPAs) — Available upon request. DPAs outline the scope, nature, and purpose of processing, and include standard contractual clauses for international data transfers

Data Subject Access Requests (DSARs) — Gymini's Compliance dashboard includes a built-in DSAR management tool. Tenants can receive, track, and fulfil data subject requests (access, rectification, erasure, portability, restriction) within the platform

Data Flow Mapping — The compliance module includes data flow mapping tools to help Tenants visualise and document how personal data moves through their operations

Right to Erasure — Tenants can delete individual Contact records, and end users can request account deletion. All associated data is permanently removed

Data Portability — Customer Data can be exported in standard formats

Privacy by Design — Multi-tenant data isolation, minimal data collection, and purpose-limited processing are built into the platform architecture

Breach Notification — In the event of a personal data breach, Gymini will notify affected Tenants without undue delay and within 72 hours, enabling Tenants to meet their obligations to notify supervisory authorities and data subjects

7.4 Australian Privacy Principles (APP) Compliance

For Australian businesses:

APP Compliance — Gymini supports compliance with the 13 Australian Privacy Principles under the Privacy Act 1988

AHPRA Requirements — For registered health practitioners, Gymini provides clinical note management, record-keeping tools, and audit logging to support professional obligations

Notifiable Data Breaches — Gymini supports the Notifiable Data Breaches (NDB) scheme. In the event of an eligible data breach, we will notify affected Tenants promptly so they can assess their obligations to the Office of the Australian Information Commissioner (OAIC)

7.5 Platform Compliance Tools

Gymini provides Tenants with the following compliance tools:

Compliance Dashboard — Overview of compliance posture across selected frameworks, with status tracking and progress indicators

Framework Checklists — Step-by-step checklists tailored to each regulatory framework, with priority-based task tracking

DSAR Management — Built-in tools to receive, track, and respond to data subject access requests within required timeframes

Audit Logging — Comprehensive, tamper-resistant audit trails recording data access, modifications, and administrative actions

Data Flow Mapping — Visual tools to document and monitor how personal data moves through the Tenant's operations

Security Controls — Configurable security settings including session timeouts, password policies, and access restrictions

Compliance Documentation — Built-in document management for policies, procedures, and evidence of compliance

Compliance Reports — Exportable compliance reports for audits and regulatory reviews

7.6 Sub-Processors

8. Connected Account Permissions

8.1 Gmail

When you connect Gmail, Gymini requests the following permissions:

Read emails (gmail.readonly) — To sync relevant emails involving your CRM Contacts

Send emails (gmail.send) — To send emails on your behalf from the Communications Hub

Modify labels (gmail.modify) — To manage email organisation

Gymini's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

You can revoke Gmail access at any time by:

Disconnecting in Gymini Settings, or

Removing Gymini from your Google Account permissions at https://myaccount.google.com/permissions

8.2 Microsoft Outlook

When you connect Outlook, Gymini requests:

Read emails (Mail.Read) — To sync relevant emails involving your CRM Contacts

Send emails (Mail.Send) — To send emails on your behalf

Read/write emails (Mail.ReadWrite) — To manage email status

You can revoke Outlook access at any time through Gymini Settings or your Microsoft Account.


9. Cookies and Tracking

Gymini uses essential cookies for:

Session management and authentication

User preferences (theme, language)

Security (CSRF protection)

We do not use advertising cookies or share cookie data with advertisers.


10. Children's Privacy

Gymini is not directed at children under 16. If a Tenant stores information about minors (e.g., junior gym members), the Tenant is responsible for obtaining appropriate parental/guardian consent in accordance with applicable laws.


11. International Data Transfers

Gymini's infrastructure is hosted in the United States and Australia. If you access Gymini from outside these regions, your data may be transferred internationally. We ensure appropriate safeguards are in place for cross-border transfers in compliance with GDPR and other applicable regulations.


12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by:
